Guiding You Through Family Law Mediation
Last updated on March 6, 2025
Mediation offers a calmer way to resolve family law issues. At Fersch LLC, we don’t act as mediators but provide guidance and advocacy for our clients during the process. Our team has over 50 years of combined experience in family court and the New York Supreme Court, so we can effectively prepare you for and guide you through mediation.
What Is Family Law Mediation?
Family law mediation is a voluntary process. A neutral third party, called a mediator, helps you and your spouse or co-parent talk through your issues. The goal is to find solutions you both agree on without going to court. The mediator guides the discussion but doesn’t make decisions for you—you do.
Common Issues Addressed in Mediation
Mediation can help resolve many family law matters, including:
- Divorce settlements
- Child custody and visitation arrangements
- Child support and spousal support (alimony)
- Dividing property (especially in high-asset divorces)
- Modifying existing agreements (like custody or child support orders)
While reaching an agreement can be difficult, mediation often makes it possible. Even after many years of marriage, when emotions run high, mediation can provide a structured way to navigate difficult conversations and find common ground.
The Mediation Process in New York
Here’s what the mediation process typically looks like in New York:
- Initial consultation: We’ll meet to understand your situation and goals.
- Preparation: We’ll help you gather documents and get ready for mediation.
- Mediation sessions: You, your spouse or co-parent and the mediator will meet. We’ll be there to support you.
- Negotiation: We’ll advocate for you and help you explore your options.
- Agreement: If you reach an agreement, we’ll review it to protect your rights before the court finalizes it.
Agreements reached in mediation are legally binding once a judge approves them and makes them part of a court order. If you can’t reach an agreement, going to court might be necessary. We’re ready to represent you in court if needed.
Is Mediation Right For You?
Mediation isn’t right for every situation. It may not be suitable if there’s abuse, domestic violence or a power imbalance between you and the other party that creates high conflict. If there’s an unwillingness to compromise after trying mediation, different approaches may be necessary.
